Initial Consultation | Pre-purchase agreement

Payment and Refund Cancellation Terms
Fees for interior design services are project and scope dependent. A detailed fee schedule will be provided in the scope of work. The purpose of this contract is to outline the expectations when entering into agreement with the design.
Payments can be made by [ credit cards/ checks/ bank transfers]. Additional fees of [ %] apply to payments made by [insert payment type]. Invoices are to be paid within [ #] of days from receiving it. Late fees of [ amount] will be applied for all late invoices.
Design fees are non-refundable. Custom products are non-refundable. Retail products may be refundable when available by the retailer. Design fees may incur at an additional rate.
Purchasing and Warranty Terms
At client's request, materials, fixtures and furnishing can be purchased on behalf of the client by the [YOUR COMPANY NAME]. When available, [your company name] will extend [ %] of trade discount to the client. Warranties for purchases will be [ client or designers name]. All warranty claims will be the responsibility of [ client or designer]. All purchases made on behalf of the client require a sign off on the order and [ insert %] deposit. Contractors & Consultants
From time to time, [ your company name] is required to work with outside contractors or consultants. Clients will sign a separate agreement with the [ list consults you work with]. [ insert company] does not provide a warranty, guarantee their quality of work, and is not responsible for their performance. [ insert company] will observe the work being done to ensure the [goal of project] is on track.
Photographs/ Videography and Publicity
Photographs or videos of your project may be used from time to time on our [ website/ social media, email] for [insert reason]. Photography will have no identifying information. By signing this contract, you release [your company name] from any liability with project photographs or video
Intellectual Property
[All concepts/ drawings/ renderings/ videos/ ], known as “project documents”, prepared by [your company], will remain at all times [ your company’s] property. Project Documents may not be used by Client for any purpose other than completion of project. Clients may share images of “project documents” on [ social media, website/ etc.]. We kindly request that all sharing credits [insert company].
Termination
This agreement can be terminated in the event that either party fail to uphold the terms. A [phone call/ in person meeting] and a written notice are required to explain the reasoning. [your company] will be compensated for [insert services] performed prior to notice of termination at the agreed fee as per the signed scope of work. [your company] shall also be compensated for all outstanding balances on purchases made on behalf of the client.
Resolution of Disputes
Client and [your company] agree that all claims, disputes or controversies of any kind arising out of or related to the performance, interpretation, breach, application or enforcement of the [contract/ letter of agreement] shall be determined by binding arbitration and not by a court of law or equity. Any claims, disputes or controversies shall be settled in accordance with the rules of [ insert your territory] of the [ insert your governing body] and judgement upon the award rendered by such arbitration shall be entered in any court having jurisdiction over the matter.
